Status of BK12 Cases

  • Surendra Gadling, Sudhir Dhawale, Shoma Sen, Mahesh Raut and Rona Wilson were arrested on June 8, 2018, under the UAPA. The Pune police failed to meet the 90 days deadline for filing the charge sheet against them. Upon appeal by the Maharashtra government, a trial court gave the police extension of time beyond 90 days, but the Bombay High Court stayed that order and refused to give the police an extension of the 90-days deadline. This meant that the arrested could get ‘default bail’ as per the law. However, upon yet another appeal the Supreme Court set aside the High Court ruling and allowed the extension, thereby denying default bail to all five arrested. They can, however, the right to apply for regular bail. Meanwhile, a 5000-page charge sheet was filed by the police on November 16, 2018 (162 days after arrest)! This charge sheet is entirely based on ‘evidence’ such as typewritten letters that are unsigned and supposedly retrieved from some computers. Sudha Baharadwaj, Vernon Gonsalves, Arun Ferreira, Varavara Rao – after their homes were raided on August 28, 2019, all of the four above were kept under house arrest until three of them (Sudha, Vernon, Arun) were taken into police custody by October 27, 2018, and Varavara Rao on November 17, 2018. Pune police filed a 1800 page supplementary chargesheet against four of the above on February 21, 2019 (176 days after their arrest). Like the first chargesheet against the June arrestees, this one too is grand in accusations and weak in substantiation. To read more on this see here
