Stop State’s Clampdown on Voices Rising in Support of Farmers’ Movement in Uttar Pradesh

We, the undersigned, condemn in the strongest possible terms, the house arrest of Richa Singh and harassment of other activists by the government of Uttar Pradesh in India. These actions constitute targeted suppression of protest and clampdown on dissenting voices by an authoritarian state.  

Richa Singh, a founding member of Sangtin Kisan Mazdoor Sangathan (SKMS) and a national convenor of the National Alliance of People’s Movements, has agitated tirelessly with the most marginalized farmers, laborers, and women in Sitapur District of Uttar Pradesh since 1996.  On January 7th, the police stopped her in her hometown of Sitapur as she was joining the tractor rally in support of the farmers’ protests against the Indian Farms Reforms of 2020 that have shaken the country since 26 November 2020. While Richa was permitted to join the rally after speaking to the authorities, she was followed by two plainclothes police personnel. That same evening, she was placed under house arrest and prevented from accessing medical care in Lucknow. 

In spite of multiple attempts to learn why Richa Singh has been placed under house arrest, the only vague reason provided by the authorities is their ‘suspicion’ that she intends to join the farmers’ protests in Delhi. The details of where the police received this information have not been shared with Richa Singh, contravening her civil rights to be informed of the basis for her house arrest. There also does not seem to be an order for the arrest.

Richa Singh’s house arrest has coincided with the harassment of activists in other parts of Uttar Pradesh, including Varanasi, where an activist-delegation complained to the Divisional Commissioner that the Police were harassing them for going to Delhi and supporting the farmers’ agitation. The Additional District Magistrate also issued a notice under Goondas Act to an activist Mr. Ramjanam, who has been directed to appear before the Court on January 15th. Kripa Verma, Fazal-ur-Rehman Ansari, Lakshmi Prasad were also subjected to similar harassment by the police. 

These incidents fit into a broader pattern of arbitrary detentions of democratic rights activists and leaders of farmer’s organizations across Uttar Pradesh and in other states of India. They are a part of the rising trend to suppress voices of dissent and people’s demands, contravening people’s constitutional right to protest. Leaders and activists from various states, as well as members of the civil society, have been placed under house arrests and prevented from showing solidarity with the farmers’ movement in Delhi. 

Such stifling of support of the farmers’ movement is a sickening attempt by the Indian state to cast the protesting farmers in Delhi as a misguided minority without broad support. The state has been trying to discredit the protests as limited to farmers from Punjab and Haryana, spreading rumors about foreign funding while invoking references to a (separatist) movement for Khalistan, and claiming that mazdoors and kisaans from states such as Uttar Pradesh and Bihar are not standing with them. Pan-Indian farmers’ solidarity, especially with its demand for MSP (minimum support price), poses a grave threat to the state’s collaboration with corporate interests. 

However, the poorest of farmers and farm laborers in organizations such as SKMS, many of them Dalit women, are clearly able see how the 2020 reforms (farmers’ bill) are disastrous for them and also for India’s food security. The state seeks to suffocate their voices in solidarity with the farmers’ movement, and any activist or leader who comes in the way is being punished.  These illegal acts against protesting citizens must be reversed. 

The international community of Indian diaspora stands in solidarity with the protesting farmers, their families, social movement organizations, and activists. We demand that:

(i) the three farm laws enacted under the Indian Farm Reforms of 2020 be immediately repealed;

(ii) state authorities across India ensure the protection of citizen’s civil rights, including their rights to protest, to stand in solidarity with the farmers’ movement, and to make demands of the elected government;

(iii) Uttar Pradesh Police immediately release Richa Singh from house arrest and allow her access to medical care and freedom of movement;

(iv) Uttar Pradesh Police and government provide adequate explanation and compensation for the unconstitutional curbing of her right to travel and to access medical care;

(v) Uttar Pradesh Police immediately withdraw the notice issued to activist Ramjanam under the Goondas Act. 

International Community Condemns the Horrifying Violence against Dalit Women by Police-State in India

We, the undersigned, strongly condemn the brutal gang rape and murder of a 19-year-old Dalit woman from Valmiki community in Hathras, in the state of Uttar Pradesh (UP), by four men from the upper-caste community of Thakurs, followed by similar rapes and killings of Dalit women in Balrampur, Bhadohi, Bulandshahr, and Azamgarh in UP, that have sent waves of shock, sorrow, and rage across India and the world.

Over and over again, the District and state administration, controlled by the ruling Bharatiya Janata Party, has humiliated and terrorized the family members of victims and survivors, mishandled and misrepresented the cases, and destroyed crucial evidence. This horror is evident in Hathras, where the police refused to hand over the rape victim’s body to her family, and cremated her in the middle of the night to eliminate all evidence — they denied her family the right to hold her for the last time, and to cremate her with dignity, with love, and with rage. The savagery of the police did not stop there — they unconstitutionally declared Hathras a containment zone to suppress protests and to isolate the family from political and civil rights groups who want to support them. In a final attempt to protect the upper-caste perpetrators, rape victim’s family has been threatened with narco tests. All vestiges of rule of law have been stripped away in the service of a Hindutva ideology, which upholds and valorizes Brahmanical caste/gender inequalities and oppression.

At this crucial historical moment when George Floyd’s brutal murder by a white police officer in Minneapolis has reignited the Black Lives Matter Movement in the U.S. and across the globe, the rapes and murders of Dalit women in U.P. by upper-caste men have galvanized tens of thousands of protestors across the world to rise up against the police state in the service of violent Hindutva in India, and to demand justice for the victims and survivors of this horrific violence. 

We stand in unflinching solidarity with all the families of survivors and victims of caste-based violence and join the women’s and feminist organizations and people’s movements across India, as well as their supporters across the world, to demand the following:

· The rapists and murderers should be punished stringently as per Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (PoA, hereafter) and all such cases in UP must be investigated expeditiously. The Allahabad High Court must constitute an independent, time-bound Commission of Inquiry into the Hathras episode and hold all perpetrators and enablers of the crime, including police and government officials, fully accountable.

· The families of all the victims must be provided with full security and safety. 

· Strict action must be taken as per PoA Act on police and government officials who refused to file an appropriate FIR in time, who cremated the victim in a clandestine way in the dead of the night, who were complicit in covering up and attempting to destroy the case and evidence, persecuting the already distraught family. 

· All state governments and Centre must ensure the scrupulous implementation of the PoA, 1989 in addition to the Criminal Law Amendments 2013 and recommendations of the Justice J.S. Verma Committee, 2013. All cases of sexual violence on Dalit and Adivasi women must be fast-tracked, as per PoA.

· The Chief Minister of UP must step down for having failed miserably to protect the constitutional, legal, and human rights of multiple marginalized sections including Dalit, Adivasis and Muslims.

· The state governments must put an end to police and administrative high-handedness, especially the increasing cases of custodial deaths. The attacks on activists, journalists and repression of dissent should stop immediately. 

· The State must stop criminalizing peaceful and democratic protests that express much needed citizens’ outrage against caste and gender-based violence or atrocities on other marginalized communities.

Act Now and Stop Facebook’s Hate Policies in India

Dear Chairs,

We’re writing from around the world out of deep concern that an American company, Facebook, has not only been turning a blind eye to hate speech and fake news – as your committee has already been investigating – but appears to be deliberately conniving with hatemongers in one of the world’s most volatile environments. In India, Facebook has not merely been negligent- it’s actually hired people who promote hate themselves, and who deliberately undercut their company’s own much-touted content rules. We request you to immediately ask Facebook to explain its conduct and to insist that it take swift action to end this complicity.

India has recently seen the rise to power of an openly majoritarian and authoritarian party, the BJP, as well as a tidal wave of hate speech that has led to lynchings, massacres and pogroms. The most recent example occurred in the national capital Delhi, where 53 people, the majority of them Muslims, paid with their lives as police watched. Not one but two Indian states feature on Genocide Watch’s list of alerts and have been described as “just one stage” short of genocide. Meanwhile, hatemongers in general and BJP leaders in particular have had free rein to spread lies, bigotry and calls for violence on Facebook.

On August 14th, a day before India’s independence day, the Wall Street Journal exposed why. It confirmed what many Indian journalists, opposition leaders and dissenters had long argued – Facebook India has been deliberately playing along with hate in India. Not only that. It turns out Facebook’s own head of public policy for South Asia, Ankhi Das, herself posted content referring to Indian Muslims as a “degenerate” community, saying it ‘speaks to me.’ She opposed action against BJP leaders who have, among other things, called for Rohingyas to be shot and peaceful protesters to be massacred, since it would lead to “political fallout.”[1] In a follow up report, the Wall Street Journal also exposed how Ankhi Das had, in internal posts, openly expressed support for the BJP and disparaged other political parties.[2] Meanwhile, senior Indian journalists Paranjoy Guha Thakurta and Cyril Singh published a book in 2019, Real Face, in which they outlined how Facebook’s own global officials were “unhappy and uneasy” about the “close proximity” of Shivnath Thukral, another senior Facebook official, “to the Narendra Modi government.”[3] Time Magazine has also carried a report that notes how independent bodies seeking to counter hate speech had raised questions over Thukral’s role.[4] Also in 2019, three out of seven of Facebook’s official ‘fact checkers’ in India were found to have themselves spread misinformation.[5] That hardly seems accidental.

In the past, Mark Zuckerberg has claimed Facebook’s actions are some kind of defence of freedom of speech. That argument is problematic in itself. But here we’re talking about Facebook itself consciously supporting hatred.

The waves of violence in India have had terrible consequences both in that country and in the entire region. The large Indian diaspora in the United States has also found itself torn apart by these political developments. In this globally connected world we don’t think it is in the interests of either the United States or India for an American company to be complicit in this, whatever it may feel its commercial interests are. Those most directly affected by Facebook’s actions cannot hold the company to account – but you can. Hence we request that you:

– Call upon Facebook to explain its conduct in India with reference to the Wall Street Journal report, and to make public records of all internal discussions involving hate speech in India, and in particular relating to action against those in power

– Direct Facebook to institute an audit of its compliance with its own hate speech rules in South Asia, with a particular focus on India, and commit to completing the audit and implementing its recommendations within four months. This has been demanded by groups in both India and the United States. This audit should be under the aegis of a genuinely neutral organisation rather than a paid for private consultant, ideally either the United Nations High Commissioner for Human Rights or the UN Special Rapporteur on Freedom of Expression (given that the UN now has an agenda on addressing hate speech).

– Call upon Facebook to remove any management personnel who have openly expressed hateful views or propagated hate speech.

– Call upon Facebook to ensure its fact checkers are genuine and neutral.

– As Indian groups have demanded, ask Facebook to put its money where its mouth is and institute a reparations fund to pay compensation and support to all victims of violence wherever audits reveal that Facebook failed to enforce its guidelines.

SOLIDARITY STATEMENT TO END CASTE PRACTICES IN SILICON VALLEY AND THE USA

On June 30, the State of California’s Department of Fair Employment and Housing (DFEH) sued Cisco Systems – a major supplier of computer networking gear that makes the internet work – indicting the company of discriminating against an engineer because he is Dalit (formerly “untouchables”). This statement from Ambedkar King Study Circle seeks solidarity from media, technology, academic community and industry professionals to end caste-based discrimination and practices in the US.

We the undersigned welcome that the State of California has sued Cisco Systems for allowing its employees to practice caste at the workplace. This incident illustrates both – the casual and commonplace presence of everyday caste-based practices at the workplace, and the more conscious practice of caste discrimination pervasive in the US amongst Indian Americans, Indians and South Asians.

According to Silicon Valley Institute for Regional Studies in 2018, there were more high-skilled workers in Silicon Valley from India (25%) than from China (15%); California (16%); or from the rest of the country (16%). We, therefore, urge, all tech-corporations in Silicon Valley to be sensitive to caste practices and caste-based discrimination at their workplaces and ensure appropriate policies and protections are in place to guarantee safe and dignified working environment to all Dalit and so-called “low” caste employees.

At the moment, US employment law does not bar caste-based discrimination. We request the California State agency to seize this opportunity to have legal protection in place to protect Dalit and other so-called “low” caste employees.

According to DFEH, a Dalit employee suffered discrimination and harassment at the workplace once his dominant caste colleague “outed” him. The complex of trauma, humiliation, devaluation of self-worth, and perpetuation of caste stereotypes (especially against Dalits) – has severe impacts on workplace conditions, the right to dignity and commitment to diversity as a bulwark of modern organizations. The last names of the alleged harassers – Iyer and Kompella – are also their dominant caste names.

As per DFEH, Iyer “outed” the Dalit employee by telling colleagues that the victim enrolled at the prestigious Indian Institute of Technology through affirmative action – a claim that includes the connotation that affirmative action is inherently devoid of “merit”. This consequently shaped the actions of Iyer and his so-called “upper caste” colleagues, and the successive line manager. They allegedly proceeded to harass the victim and assigned unrealistic tasks to set him up for failure.

Caste is a hierarchical category based on pre-set social identities of birth and ancestry or descent. In its historical origins, caste has a close relation to occupation and exploitation. This nexus continues with some changes in modern times. The most excluded caste groups now self-identify as Dalits.

Dominant caste groups, for centuries, forcibly assigned occupations to Dalits and stigmatized those occupations. This stigma continues even after Dalits move outside of caste-affected societies and find new professions such as engineers in Silicon Valley. In the words of one of India’s foremost modern public intellectuals, chief drafter of the Indian Constitution, the most influential leader of Dalits in the 20th century, and an economist, anthropologist and philosopher – Dr B.R. Ambedkar: “the caste system is not merely a division of labour. It is a division of labourers.” In the minds of oppressors, the Dalit victim did not and should not belong to that workplace.

We now know that the victim had filed complaints as early as in November 2016 to the Cisco Human Resources (HR) department about the discriminatory behaviour of his dominant caste line managers. However, Cisco HR did not act on these complaints on the ground that caste discrimination was not unlawful in the US. We, therefore, appeal to all American companies, including those in Silicon Valley to be sensitive to ubiquitous caste practices and caste-based discrimination. We urge them to recognize caste, as operating similarly to race and gender as a source of discrimination and harassment and incorporate caste practices as an unfair and punishable practice in their Human Resource policies.
